The Legal Challenges of Deepfake Technology: Digital Evidence, Identity, and Cybercrime

Deepfake technology has emerged as one of the most significant technological developments in the field of artificial intelligence and digital media. By using sophisticated machine-learning techniques, deepfake systems can generate or manipulate images, videos, and audio recordings to create highly realistic representations of individuals and events. Although the technology has legitimate applications in entertainment, education, research, and digital communication, its misuse presents substantial challenges for legal systems. Deepfakes may facilitate identity fraud, financial deception, reputational harm, cybercrime, misinformation, and manipulation of digital evidence. This article examines the technological characteristics of deepfakes and analyzes the principal legal challenges associated with their creation, distribution, and use. Particular attention is given to digital evidence, authentication, privacy, identity protection, cybercrime, intermediary responsibility, and the difficulties faced by courts in distinguishing authentic media from synthetic content. The article proposes a technology-oriented legal framework involving digital provenance, forensic detection, watermarking, authentication standards, platform responsibility, and human verification. It concludes that technological innovation in synthetic media requires corresponding developments in legal and evidentiary frameworks to preserve trust in digital information
