Electronic Evidence in the Age of Artificial Intelligence: Legal Challenges of AI-Generated and AI-Enhanced Digital Evidence

The rapid development of artificial intelligence has fundamentally transformed the creation, modification, analysis, and presentation of digital information. AI systems are increasingly capable of generating realistic text, images, audio, video, and synthetic records, creating new opportunities for digital investigation while simultaneously challenging traditional concepts of evidentiary authenticity and reliability. This article examines the legal and technological challenges associated with AI-generated and AI-enhanced electronic evidence. It focuses on deepfakes, synthetic media, automated document generation, AI-assisted forensic analysis, metadata manipulation, authentication, chain of custody, and evidentiary reliability. The article argues that traditional methods of authenticating electronic evidence may become increasingly difficult when sophisticated AI technologies can reproduce or manipulate digital content with high levels of realism. It proposes a technology-supported evidentiary framework based on cryptographic verification, provenance tracking, secure metadata, digital signatures, forensic preservation, AI-generated-content detection, and expert examination. The article further emphasizes the importance of judicial awareness and procedural safeguards when evaluating technologically complex evidence. It concludes that the legal system should neither automatically reject AI-generated evidence nor presume its reliability, but should evaluate such evidence through transparent, verifiable, and technologically informed evidentiary procedures.
