Legal Governance of Artificial Intelligence in Smart Cities: Privacy, Cybersecurity, Algorithmic Accountability and the Protection of Fundamental Digital Rights

The rapid development of smart-city technologies has transformed conventional urban environments into interconnected digital ecosystems incorporating artificial intelligence, Internet of Things devices, cloud computing, biometric identification, intelligent transportation, predictive analytics, and automated public services. While these technologies can improve urban efficiency, security, sustainability, and service delivery, their extensive use also generates complex legal challenges concerning privacy, cybersecurity, surveillance, algorithmic accountability, data governance, and fundamental digital rights. This article examines the legal governance of artificial intelligence within smart-city environments, with particular attention to automated decision-making, large-scale data collection, biometric surveillance, cybersecurity vulnerabilities, and the responsibilities of public authorities and private technology providers. It argues that technological efficiency cannot by itself justify unrestricted data collection or automated decision-making. A rights-based governance model is therefore necessary to ensure that smart-city development remains consistent with principles of legality, necessity, proportionality, transparency, accountability, and human oversight. The article proposes an integrated framework based on privacy by design, data minimization, secure digital infrastructure, algorithmic auditing, independent oversight, transparent data-sharing arrangements, and effective remedies for affected individuals. It concludes that sustainable smart-city development requires a balance between technological innovation and legal protection, ensuring that digital transformation strengthens public services without undermining privacy, autonomy, equality, and public trust.
